What is a medical examination video?
Capturing a medical exam on video brings parties into the examination room while being minimally invasive to the examination proceedings. The video also provides accurate time references as to the start, ending and duration of the exam. Videotaping the exam allows the attorney to compare the exam performed by the Independent Medical Exam physician with that of the plaintiff's treating physician.
A Medical Exam video can also be used as part of a separate Day in the Life Documentary. Show not only the exam itself, but visually demonstrate what your client has to go through and endure as part of their new life dealing with their injury, or disability.
This can also include documenting the plaintiff's rehabilitation appointments, or sizing and fitting them with new prosthetic limbs.
INDEPENDENT MEDICAL EXAM (IME)
Your case may depend on whether you videotape the Independent Medical Exams that occur in your case. An IME occurs when a medical professional, who has not previously been involved in a party’s care, examines a party. There is not a doctor/therapist-patient relationship. Courts may allow an IME to be conducted to determine the cause, extent and medical treatment of an injury at issue in your litigation. The Independent Medical Exam is also likely to assert an opinion as to whether a party has reached maximum medical improvement, and whether any permanent impairments exist. You would not leave your client alone with opposing counsel, so don't leave them alone with opposing counsel’s paid expert. You should always make sure to utilize an Independent Medical Exam video. In the same way that you maintain an objective record of all depositions, be sure to create a video record of all Independent Medical Exams.
COMPULSORY MEDICAL EXAM (CME)
In a personal injury or medical malpractice case, medical exams of the injured plaintiff are commonly part of the discovery tools permitted at trial. A Compulsory Medical Examination, or CME, is an evaluation requested by either the plaintiff's insurance carrier or the carrier of the defendant.
